McCulloch v. Maryland
(1819) Sentencia de la Corte Suprema de los Estados Unidos de América que confirmó la doctrina constitucional de los poderes implícitos del congreso.

En el caso se discutió si un banco nacional que acababa de crearse podía o no fiscalizar la emisión de moneda por los estados, entre ellos el estado de Maryland. El fallo unánime, redactado por John Marshall, estableció que el congreso no sólo tiene las atribuciones que expresamente le confiere la constitución, sino también la autoridad necesaria para su adecuado ejercicio, en este caso la creación de dicho banco. Esta doctrina, extraída de la "cláusula elástica del artículo primero, fue elemento importante para el aumento sostenido de los poderes federales. Además reforzó la facultad de control de la constitucionalidad establecida en el caso Marbury v. Madison (1803).
